You are expected to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users.

 

1. Disclaimer:-

1.1 SEO it Right Ltd takes no responsibility for any damages or losses client may suffer from using our service(s). Client agrees that SEO it Right Ltd takes no responsibility for the data contained within client’s personal directories; however client assumes full responsibility of the data.

1.2 SEO it Right Ltd would not be responsible for any damages your business may suffer. SEO it Right Ltd disclaims any warranty or merchantability or fitness for a particular purpose. This includes, but is not limited to, loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by SEO it Right Ltd and its employees.

 

2. Abuse & Prohibited Use:-

2.1 The services of SEO it Right Ltd web hosting can only be used for lawful purposes. Storage or distribution / transmission of illegal data is strictly prohibited. SEO it Right Ltd reserves the right to decide as to what constitutes as abuse and any material not mentioned below is left entirely up to the discretion of the SEO it Right Ltd staff.

2.2 The list of prohibited data includes, but is not limited to -

(a) IRC Bots / Software

(b) BitTorrent software

(c) Proxy software

(d) Any Automated Bots

(e) Warez Sites and Indexing / Linking to other warez sites

(f) HYIP Sites

(g) Hate Sites

3. Abuse can include, but is not limited to the following offenses:-

3.1 Any attempts to compromise or actual compromise of a network device belonging to SEO it Right Ltd or any other company, individual, or other entity is strictly prohibited. This offense also includes port scanning, IP range scanners and vulnerability scanning. All infractions and or suspected infractions will be vigorously investigated and may result in immediate termination of service.

 

3.2 Denial of Service (DOS) attacks directed at SEO it Right Ltd or any attempts to launch a Denial of Service attack from our servers are strictly prohibited. All infractions and or suspected infractions will be vigorously investigated and may result in immediate termination of service.

3.3 Hosting any software, source code or any other material that is illegal or could be used to commit an illegal act is strictly prohibited. This includes but is not limited to software exploits; exploiting source code, hacking tutorials, hacking tools, phishing, viruses and Trojans, bomb making and similar device tutorials. All infractions and or suspected infractions will be vigorously investigated and may result in immediate termination of service.

3.4 The hosting of material that infringes on any copyright, trademark and or service mark is strictly prohibited. This also includes the storage and transmission of pirated movies, music, software, ring tones or anything else considered "Warez". Any authentic complaint received will be investigated and may result in termination of service.

3.5 The hosting of defamatory, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights.

3.6 MS-SQL Databases cannot exceed 400 MB in size at any time. This also includes the log file of the particular database.

 

4. Zero Tolerance Spam Policy:-

4.1 If you send unsolicited email messages, commonly known as SPAM, your account WILL be terminated, NO exceptions. Sending newsgroup postings, chain letters or anything else that could be considered as "spam", is strictly prohibited. The gathering of email addresses to be used for sending unsolicited email on a 3rd party service "harvesting" is also prohibited and may result in termination of service.

4.2 We have set a limit of 500 outgoing emails per hour. Customers need to take note of this restriction that they cannot send more than the specified number of emails every hour.

4.3 Spamming activities also include (but not limited to) commercial advertising and informational announcements. A user shall not use another site's mail server to relay mail without the express permission of the site or distributing, advertising or promoting software or services that have the primary purpose of encouraging or facilitating unsolicited commercial E-mail or spam.

 

5. Resource Usage:-

5.1 Abuse of resources include, but is not limited to:-

5.1.1 Usage 25% or more of system resources for longer then 90 seconds. These include, but are not limited to: CGI scripts, FTP, PHP, and HTTP.

 

5.1.2 Run any interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.

5.1.3 Run stand-alone, unattended server-side processes at any point in time on the server. This includes, but is not limited to, IRCD, BotProcesses.

5.1.4 Run any software that interfaces with an IRC (Internet Relay Chat) network.

5.1.5 Run any gaming server instances. This includes, but is not limited to, such as counter-strike, half-life & battlefield 1942.

5.1.6 Repeated infringements on account of excessive server-resource consumption may result in suspension OR termination of services.

5.1.7 JailShell Access

 

6. Bandwidth Usage:-

Bandwidth is defined as the amount of traffic that is allowed to occur between your website & the rest of the internet. All bandwidth quotas are on a monthly basis. The amount of bandwidth allowed is commensurate to the subscribed hosting plan. SEO it Right Ltd reserves the right to suspend services for an account which has exceeded the bandwidth quota allotted. Services would be restored on the start of the next cycle or Upgradation of the hosting package, whichever is earlier. Carrying over of unused amount of bandwidth is not permitted.

 

7. Payments, Verification & Account Setup:-

7.1 SEO it Right Ltd will not activate any service(s) until client has paid in full. Until and unless you notify SEO it Right Ltd of your desire to cancel any or all services received, those services will be billed on a recurring basis. Clients have to make appropriate payment for the services received from seo-it-right.co.uk, before the payment due date during the duration of the services received. SEO it Right Ltd reserves the right to change the monthly payment amount and any other charges at anytime.

7.2 All payments and service orders are screened for fraudulent transaction & credit card abuse. If a payment is found not to be compliant with our verification & screening procedures, such orders won’t be setup. Payments are automatically rejected.

7.3 Account setups are done after payment verification. Only accounts which have been paid for in full would be setup.

 

7.4 Clients acknowledge and agree that details of their name, address, telephone and fax numbers together with email address(es) and assigned IP Addresses may be released to the RIPE NCC to ensure that both WE and YOU fulfill their obligations under prevailing RIPE policies and that such data may be published in whole or in part in the RIPE WHOIS database.

 

8. Cancellations & Refunds:-

8.1 SEO it Right Ltd reserves the right to suspend OR terminate services on receipt of Abuse complaints. An unconditional 30 day money back guarantee is provided on managed shared hosting, reseller hosting, semi-dedicated hosting and VPS solutions. Domain registration Fees & Dedicated Server packages do not come under the purview of this guarantee. Refund requests after 30 days will be refunded on a prorated basis of any unused time.

8.2 Only first-time accounts are eligible for a refund. For instance, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.

8.3 There will be no refund for new domain registrations, WHM/CPanel, Plesk VPS & Dedicated Server License, Virtuozzo, SSL Certificates and Site Builder as these are purchased from External Vendors & SEO it Right Ltd does not get any refund in case of cancellation of licenses.

8.4 Any service interruptions or downtime due to scheduled maintenance by SEO it Right Ltd or our network providers will not count towards the uptime guarantee. SEO it Right Ltd is not liable in any way for failure of third party services.

 

9. Data-backups:-

Although, all possible attempts would be made to retain a working backup copy of data; SEO it Right Ltd does not assume any responsibility of backing up files & data residing in your hosting account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on seo-it-right.co.uk servers. Any backup which may be provided to the customer will not include media files.

 

10. .co.uk domain registration:-

When buying a .co.uk domain you agree to be bound and abide by the nominet terms and conditions found at http://www.nominet.org.uk/registrants/aboutdomainnames/legal/terms.

 

12. Money back Guarantee:-

12.1 Dedicated Servers, Colocation services & Domain Registrations are not included under the 30-day money back guarantee policy. SEO it Right Ltd reserves the right to decide whether or not to issue pro-rated refunds under such circumstances. If you find the services to be deficient or unsatisfactory, you are entitled to a full refund of the contract amount within the first 30-days of the date of account set-up.

12.2 We also provide a Price-Freeze guarantee. You would never have to pay more than what you signed up for your hosting service. SEO it Right Ltd reserves the right to change the resource allocation for its services & also to change the prices listed on the website.

Terms of Sale

Payment

Cash or Personal Cheque with Bankers Card, all major Credit/Debit Cards, Bankers Draft or BACS Transfer are all acceptable methods of payment. Our Terms are payment in full within thirty days. Monies that remains outstanding by the due date will incur late payment interest at the rate of 2% above the prevailing Bank of England's base rate on the outstanding balance until such time as the balance is paid in full and final settlement. We reserve the right to seek recovery of any monies remaining unpaid sixty days from the date of invoice via collection Agencies and/or through the Small Claims Court in the event that the outstanding balance does not exceed £3000. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.

 

Returned cheques will incur a £25 charge to cover banking fees and administrative costs. In an instance of a second Returned cheque, we reserve the right to terminate the arrangement and, if agreed to, we shall insist on future cash transactions only. Consequently, all bookings and/or transactions and agreements entered into will cease with immediate effect until such time as any and all outstanding monies are recovered in full.   

 

Termination of Agreements and Refunds Policy

SEO it Right has the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect of the provision of unused Services shall be refunded.

 

Cancellation Policy

Minimum 30 days notice of cancellation required. Notification for instance, in person, via email, mobile phone ‘text message’ and/or fax, or any other means will be accepted subject to confirmation in writing. We reserve the right to levy a £30 charge to cover any subsequent administrative expenses.

 

Availability
Unless otherwise stated, the services featured on the SEO it Right website are only available within the United Kingdom, or in relation to postings from the United Kingdom. All advertising is intended solely for the United Kingdom market. You are solely responsible for evaluating the fitness for a particular purpose of any downloads, programs and text available through this site.

8.7 Failure by SEO it Right to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy.

8.8 A person who is not a party to these terms and conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any of the terms and conditions hereby set out. This shall not affect any right or remedy of a third party which exists or is available apart from that Act.

8.9 SEO it Right shall not be responsible for any breach of these terms and conditions caused by circumstances beyond its control.

8.10 The headings in these terms and conditions are for convenience only and shall have no legal meaning or effect.
